Discord is looking for an exceptional Trust & Safety Counsel to join our growing legal team. This is a high-impact role at one of the most interesting companies on the planet! As our second Trust & Safety counsel, you will support our Trust & Safety organiztion as it seeks to respond to law enforcement data requests, identify and remove harmful content and actors from the Discord platform, and comply with obligations under global laws and regulations.
What you’ll be doing
- Provide legal guidance to our Law Enforcement Engagement and Response (LEER) team relating to user data and content takedown requests from governmental entities.
- Engage with law enforcement agencies concerning responses to legal process and proactive disclosures, where appropriate.
- Respond to and resolve escalations relating to law enforcement matters generally.
- Manage Discord’s response to third-party civil and criminal defense subpoenas.
- Develop and improve guidance documents, workflows, training materials, and other resources for use by LEER and other Trust & Safety teams.
- Proactively identify areas of risk and compliance gaps in Trust & Safety operations and participate in developing policy, process, and/or product enhancements to address them.
- Provide legal guidance to Trust & Safety staff responding to takedown requests submitted under the Digital Millennium Copyright Act and engage with rightsholders as necessary.
- Provide guidance to Trust & Safety teams in response to escalations in light of applicable law and Discord policies.
- Support Discord’s engagement with regulators and policymakers on Trust & Safety issues including law enforcement matters.
- Collaborate with cross-functional partners to translate internal policies into actionable processes and tell Discord’s Trust & Safety story.
What you should have
- A JD from an accredited law school and admission to the bar of a relevant jurisdiction
- 7+ years of experience as a prosecutor with the U.S. Department of Justice or at in-house tech legal department (consumer-facing platform preferred) supporting law enforcement and/or supporting law enforcement response operations
- Strong knowledge of laws regarding user data disclosure, including the Stored Communications Act, Pen Register Act, Wiretap Act, CLOUD Act.
- Experience working on multiple projects to deliver practical advice under pressure and comfort operating within ambiguity, prioritizing, and consistently achieving results
- Excellent written and oral communication skills
- Expert relationship builder with an attitude of open-mindedness, collaboration, flexibility, empathy, a growth-mindset, kindness, and being humble
Nice to have
- You are familiar with Discord and the video game industry and/or online communication industry
- Knowledge of global laws and regulations implicating trust and safety, such as 18 U.S.C. § 2258A, the Take It Down Act, the EU’s Digital Services Act, the EU’s Terrorist Content Online Regulation, UK and Australia Online Safety Acts, Brazil’s Digital ECA, etc.
- Experience dealing with foreign governments and/or foreign legal process
- Experience delivering training to law enforcement or governmental entities
- Experience handling sensitive and/or confidential matters
- A previous or current security clearance
- Familiarity with the Digital Millennium Copyright Act and takedown notices and/or working with rightsholders
The US base salary range for this full-time position is $248,000 - $279,000 + equity + benefits. Our salary ranges are determined by role and level. Within the range, individual pay is determined by additional factors, including job-related skills, experience, and relevant education or training. Please note that the compensation details listed in US role postings reflect the base salary only, and do not include equity, or benefits.
